Is this trial different? Yes … here’s why

The men and women who will prosecute the second impeachment trial of Donald Trump have filed their legal brief in advance of that process.

It states, in part: “The Nation will indeed remember January 6, 2021 — and President Trump’s singular responsibility for that tragedy. It is impossible to imagine the events of January 6 occurring without President Trump creating a powder keg, striking a match, and then seeking personal advantage from the ensuing havoc.”

My head and my heart are conflicting with each other as the nation prepares to witness this spectacle unfold. My heart desires a conviction, even though Donald Trump no longer is in office. He needs to be held accountable for inciting that horrifying riot.

My noggin tells me something different. It is that the House managers who will prosecute this case will be speaking to a “jury” that has made up its mind. Fifty Senate Democrats want to convict the former president; some of the 50 Republicans may join them, but not enough of them will cross that threshold to deliver a conviction.

The Constitution sets a high bar, requiring a two-thirds vote in the Senate to convict a president.

So, why is this trial different from the first trial that acquitted him on abuse of power and obstruction of justice? It is different because the crime Trump committed on Jan. 6 had a direct impact on the jurors, the senators who will be sitting in judgment.

Trump incited the rioting mob to march on Capitol Hill. The terrorists did as he stated. They stormed into the Capitol Building, where senators and House members were meeting to certify the results of the 2020 election. Senators and House members were sent scurrying; they feared for their very lives!

How in the name of sanity does someone give a pass to someone who incited that kind of violence when it could have resulted in catastrophe for those who will pass judgment? You cannot!

Trump has assembled a new defense team; the first one quit because of differences with the client over trial strategy. The new team will argue that the Senate lacks standing to try a president who isn’t in office. This layman believes that argument is so much crap!

This trial should be dramatically different from the first one. If there exist enough Republican senators with a sense of moral outrage over what happened on the very floor where they will hear this case, then there well could be a vastly different outcome.

Sadly, I fear that the cowards among the GOP caucus are going to win the day.

Trump team bales out?

Under normal, legal circumstances the decision by Donald Trump’s legal team to bale out of a pending defense of their client would have me clapping my hands.

As idiotic as the former president’s strategy reportedly is playing out, though, I am going to withhold any hope that there might be an actual conviction coming from the upcoming trial in the U.S. Senate.

Trump is getting ready to stand trial on a charge that he incited the insurrection that occurred on the Sixth of January. He did as has been accused. I saw it. You saw it. The world saw Trump whip the crowd into a frenzy before it marched on Capitol Hill. The House impeached him for it. The Senate will put him on trial even though he has left office.

Trump’s legal team exited the scene reportedly over a disagreement with its client on defense strategy. The lawyers wanted to defend Trump on the basis of a constitutional argument, that the impeachment trial doesn’t fit the Constitution’s provision for removal from office if a conviction is the result. I believe that’s a long shot legal argument.

But then we have Trump wanting the legal eagles to argue on the basis of The Big Lie, that there was widespread vote fraud in the 2020 presidential election. They declined. Then they walked. Who can blame them? Trump’s argument is moronic in the extreme.

So now Trump has no legal team to defend him against the House impeachment. Should he sweat it? No. Why? Because this isn’t strictly a legal trial being conducted in a court of law. The Senate is going to deliver, more than likely, a political verdict. Senators likely already have made up their mind. Heck, 45 GOP senators voted that the trial is unconstitutional, which suggests to me that the Senate is far from likely to convict, given that the Constitution calls for 67 senators to vote for it; a 50-50 Senate split requires 17 Republicans to make that call.

About the only thing the reporting of the lawyers bugging out tells me is that Trump is clinging to a ridiculous notion that has nothing to do with the issue at hand: Did he incite the terrorist mob to attack the Capitol with the intent of stopping Congress from certifying President Biden’s victory in the 2020 election?

Umm. Yeah. He damn sure did!

Elections have consequences!

If I hear it one more time my head is likely to explode.

It is that Donald Trump’s supporters’ mantra that their guy pulled in 74.2 million votes in the 2020 presidential election, which means — by God — that they won’t be silenced.

OK. I got it. Here is another truth about that election: President Biden garnered 81.2 million votes, 7 million more than Trump; moreover, he won the Electoral College with 306 votes, needing 270 to win the presidency.

Biden won. Trump lost. Elections, as the saying goes, have consequences!

A democratic society requires that losing candidates accept defeat, congratulate the winner, pledge to work together … and yes, also keep pushing for whatever agenda he or she sought during a losing campaign. Donald Trump didn’t do that. He hasn’t done that yet. He apparently will never do any of it.

Instead, he is leading his minions on some sort of call of defiance, ginning up their enthusiasm for a campaign that did not resonate with most Americans who voted in record numbers.

I know what some of you might be thinking. What about the 2016 election when supporters of Hillary Clinton yapped about their candidate getting more votes than Trump? There is no parallel. Clinton pulled in about 3 million more votes than Trump, but lost the Electoral College by the same amount that Trump lost to Biden. There were those who said their voices needed to be heard. Why? Because their candidate collected more rank-and-file support than the actual winner. I was not one of those individuals.

Yes, I was highly critical of Donald Trump during his term as president, but I also recognized that the Constitution prescribes a certain way that candidates win presidential elections, and in 2016 Trump met that standard.

The 2020 result was clear cut. The actual vote comported with the Electoral College vote. So, when the Trumpkin Corps yaps about their guy winning 74.2 million votes, I am left to shrug and say: So fu**ing what? 

The other guy got more votes than your guy! Your guy lost. The Trumpkins have every right to express their point of view; the Constitution is clear about that. But … do not rely on the tired mantra that just because the losing candidate for president won a lot of votes that it means he can still have his way.

Donald Trump said it himself after hearing the gripes of those who supported his opponent four years ago: Elections have consequences.

Trump library? Really?

This thought comes from a member of my family, but it’s so good I have to share it here.

We talked about whether Donald Trump is going to build a presidential library. My own thought is that it is impossible to couch this man’s tenure in office in any positive light, given the horrendous end he brought to it: the insurrection that capped off his refusal to accept defeat at the hands of President Biden, not to mention the two House impeachments and Senate trials.

However, the conversation this morning turned to this idea: Donald Trump won’t build a free-standing structure, but instead will have a room set aside in one of his posh hotels.

As my family member noted: He can put it between the workout room and the breakfast buffet.

I now open the floor for comments. I happen to think that is a workable idea.

Get this trial done quickly

President Biden has gone on the record, saying he wants Donald Trump’s Senate trial done quickly, that there is no compelling need to drag this charade any longer than necessary.

I agree with him.

It’s probably no stretch to presume that Joe Biden shares the views of many millions of Americans who want the Senate to convict the former president, even though removal from office no longer is possible. I damn sure want him convicted. I also want the Senate to approve a provision that bans Trump from seeking public office ever again.

A 55-45 vote in the Senate the other day, though, likely spelled doom for a conviction. Only five GOP senators joined their Democratic colleagues in determining that the trial is constitutional.

Back to the president’s point about a speedy trial. Yes, I am weary of presidential impeachment talk, of the morass it creates. As for President Biden urging a swift outcome, it is because he has an aggressive COVID relief agenda he wants Congress to enact. He wants to get the legislative branch on the fast track to providing economic relief, not to mention getting the nation on the road to  full recovery from the killer pandemic.

A drawn-out impeachment trial would take senators’ eyes off the legislative prize.

Let’s get real for just a moment, too.

Gutlessness is alive in both houses of Congress. The 10 Republican House members who voted to impeach Trump are facing the wrath of constituents back home. That electoral anger frightened other House members into doing what they likely know is right, that  Donald Trump incited a riot that could have resulted in many casualties than it did. Still, the House impeached Trump.

As for the trial, the Constitution requires two-thirds of senators to convict. The bar is high, as it should be. However, the cowardice that too many House members exhibited is showing itself in the Senate.

A second Senate acquittal of the corrupt, amoral and moronic former president now appears to be a fait accompli. There is no need, therefore, to drag this charade on.

What about Donald Trump’s political future? My strong hope is that he sealed it with his hideous post-election response, his fomenting of the Big Lie about widespread vote fraud that did not exist.

I stand with President Biden in wanting a quick end to this chapter. Then Congress can get to work seeking an end to the pandemic and rescuing a collapsing economy.

Putin isn’t your pal, Mr. POTUS

President Biden and Russian dictator Vladimir Putin chatted the other day.

They reportedly covered — according to a read-out supplied to the media by the White House — a number of topics. They included at least two topics that Donald Trump refused repeatedly to mention to his pal Vlad: the bounty paid to Taliban terrorists who kill American service personnel on t he battlefield and the Russian interference in our elections.

What a change in tone. What a welcome change.

President Biden has made it clear, or so it appears, that he doesn’t plan to be Vladimir Putin’s friend. He wants to assert U.S. moral authority. He wants to engage Russia on nuclear arms reduction. Biden intends to face Russia down on its efforts to subvert Ukraine.

Trump boasted of his deal-making prowess but he never came close to negotiating a nuclear arms reduction deal with his good pal Putin.

Biden enters this relationship with a long history of involvement in foreign policy discussions. Let’s remember that he formerly chaired or was ranking member of the U.S. Senate Foreign Relations Committee before he became vice president for two terms serving under President Obama.

Indeed, the White House read-out of the meeting is something the public didn’t get for the past four years during Donald Trump’s term. No one ever knew what the two men talked about, except what Trump would say out loud; and we all know how believable Donald Trump could be, right?

To be sure, the read-out only reveals what the White House wants us to know. However, my own sense is that the Biden administration will deal much more forthrightly and candidly with Vladimir Putin than the Trump administration ever did.

President Biden has laid down an important marker at least by challenging Putin on the hideous report of the bounties he paid for the lives of American service personnel.

Don’t let up, Mr. President.

Trump likely to escape … again!

Virtually all of me wants the Senate to convict Donald Trump of “incitement of insurrection.”

No matter how much I want to will the Senate to do the right thing, political reality is staring all of us in the puss. Conviction requires 17 Senate Republicans to join their Democratic colleagues in convicting Trump.

A conviction won’t remove him from the presidency. A clear majority of voters did that on Nov. 3 when we elected Joe Biden to be our next president. Oh, I am so happy to among the 81.2 million Americans who spoke loudly and clearly.

Let  us face reality, though.

Donald Trump still commands the attention of too many Senate Republicans, who fear the Trumpster Corps scattered across the land. The Trump cultists are rattling their proverbial sabers, threatening senators with dire political consequences if they vote to convict their guy, The Donald, the former Liar in Chief, the huckster, the con man, the phony, the fraud … stop me before I run out of breath.

Only five GOP senators voted this week that the trial is constitutional. They are right. The 45 Rs who stuck together are wrong. The Constitution doesn’t require a president to be in office for the House  to impeach him. Indeed,  the House did impeach Trump — for the second time! — just a week before he left office.

Now he is gone. The aim of the Senate is to secure a conviction and then to cast a simple-majority vote to deny Trump from ever seeking public office.

Here,  though, is another reality. Donald Trump will not be elected president ever again! His sounding the bugle for the terrorists who stormed Capitol Hill on the Sixth of January sealed his political fate.

If only the Senate could find enough Republicans with sufficient courage to convict him. I fear the worst outcome, that Donald Trump will skate through this latest Senate trial.

Waiting for normal political climate

One of these days, maybe soon, Americans are going to get past the aftershocks of the political era that ended earlier this week.

Donald Trump has exited the White House. President Joe Biden has gotten right to work. But wait! We have another Senate trial awaiting us.

That, too, will become history. Senators can concentrate on other issues that affect the many millions of us who are weary of the pandemic, those who have been sickened by it, those who are mourning the loss of loved ones.

I am waiting with a certain degree of anxiousness for an end to the turmoil that continues to roil the waters.

It might take a long, long while for total normality to return. I am hoping we can experience that return even in increments. If we continue the journey back from the tempest that Donald Trump created almost daily, we will realize the progress we are making in real time.

I am acutely aware that there will be impediments to that recovery. It rests largely with the Trumpsters who continue to occupy public offices and those who bought into the Big Lie that Trump kept fomenting, the one about alleged voter thievery in the presidential election. We all witnessed the result of what that gullibility produced; the Capitol Hill insurrection was frightening in the extreme and to be candid, I haven’t gotten over it yet.

A new day will arrive. We will be cleansed eventually from the toxicity that Donald Trump brought us.

I am ready for a new day.

Let the trial begin …

Senate Majority Leader Charles Schumer has made it official.

The U.S. Senate will commence the second impeachment trial of Donald Trump on Feb. 8. That’s fine for a couple of key reasons.

The House will send the Senate the single impeachment article on Monday, triggering the eventual start of the trial. The House of Representatives impeached Trump on a charge of incitement of insurrection. You saw what he did on the Sixth of January, inciting the riot that stormed Capitol Hill while Congress was meeting to certify President Biden’s victory on Nov. 3.

Why is the delay in the trial a good thing?

For one, Donald Trump is entitled to the best defense he can get. A delay allows the former president to assemble a legal team to defend him in the Senate. For the life of me I don’t know how you defend what I witnessed was the indefensible. Trump’s team will try to accomplish what I consider to be the impossible.

Secondly, delaying the trial enables the Senate commence on the important task of confirming President Biden’s Cabinet nominees and get to work on important legislation concerning pandemic relief, climate change, immigration reform and other issues the president has deemed critical.

I get that the Senate can “walk and chew gum at the same time,” as senators have noted. Delaying a trial won’t do any harm to determining the outcome. A delay allows Trump’s team to get its stuff together; it also allows House managers to do the same.

And so … let the trial begin eventually and let Congress get to work repairing the damage that the former president inflicted on our government.

Will any terrorists show up at Mar-a-Lago?

I cannot help but wonder, given Donald Trump’s initial expression of “love” for the terrorists who attacked Capitol Hill on The Sixth of January …

Is the former president going to invite any of ’em to Mar-a-Lago for dinner and drinks with him and Melania?

Heavens no. Which directs me to the amazing irony of the lunatics who sought to disrupt Congress from declaring Joe Biden the winner of the 2020 election.

It is that Trump doesn’t give a rat’s a** about the individuals who shattered the nation’s psyche in his name. They were mobsters, terrorists, rioters who poured into Washington because they swallowed the diet of lies that Donald Trump fed them. He said the election was fraudulent. That the result was “stolen” by hordes of illegal voters. That Trump, not Biden, won the election in a “landslide.”

We witnessed an amazing phenomenon on the sixth day of this month. Militants stormed into the Capitol Building. Many of them are known to be white supremacists; they are Holocaust deniers; they have KKK sympathies. They came from all over the nation.

One of them is a North Texas Realtor who said she was just doing her duty as a patriotic American. Hah! She committed an act of treason, in my humble view.

Meanwhile, their hero will be luxuriating in his posh resort in South Florida. He will have not a damn thing to do with any one of them.

They thought they were making America great again.
